Terms of Service

By creating an account or using any part of the Tygent platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use the platform.

These terms apply to all users of the platform, including interviewers, recruiters, hiring managers, and any other individuals or organizations accessing the service.

We reserve the right to update these terms at any time. Material changes will be communicated through the platform or via email. Continued use after changes are posted constitutes acceptance of the updated terms.

You are responsible for maintaining the confidentiality of your account credentials, including your password and any access tokens. You agree to notify us immediately of any unauthorized access to your account.

You must provide accurate and complete information when creating your account. Misrepresentation of your identity, role, or organizational affiliation may result in account suspension or termination.

You are responsible for all activity that occurs under your account, whether or not you have authorized that activity. We are not liable for any loss or damage arising from unauthorized use of your account.

You may use the platform to upload resumes, paste job descriptions, run AI-powered candidate analyses, generate interview questions, and review hiring recommendations — all for legitimate recruitment and hiring purposes.

You must not upload content that is unlawful, discriminatory, defamatory, or that violates any third party's intellectual property rights or privacy rights. You are solely responsible for ensuring you have the right to process any candidate data you upload.

You must not attempt to reverse-engineer, decompile, or extract the underlying algorithms, models, or source code of the platform. You must not use automated scraping tools, bots, or other means to extract data from the platform beyond what is provided through the intended interface.

You must not use the platform to make automated hiring decisions without human review. The platform is designed to support and inform human decision-making, not to replace it.

You retain full ownership of all resumes, job descriptions, and other content you upload to the platform. We do not claim any ownership rights over your uploaded content.

By uploading content, you grant us a limited, non-exclusive license to process, analyze, and store that content solely for the purpose of providing you with the platform's services, including AI-powered analysis and report generation.

Analysis results, match scores, interview questions, and hiring recommendations generated by the platform are provided to you as part of the service. You may use these outputs for your internal hiring purposes.

We may use anonymized, aggregated usage data to improve the platform, but we will never use your specific documents or candidate data for model training without your explicit consent.

The platform uses artificial intelligence, including OpenAI's language models, to analyze resumes and job descriptions. While we strive for accuracy, AI-generated outputs may contain errors, omissions, or biases.

All match scores, risk assessments, interview questions, and hiring recommendations should be treated as decision-support tools, not as definitive evaluations. You are responsible for exercising your own professional judgment in all hiring decisions.

We do not guarantee that the platform's analysis will be error-free, unbiased, or suitable for any particular hiring decision. The platform should be used as one input among many in your hiring process.

We continuously work to improve the accuracy and fairness of our AI models, but we cannot guarantee specific outcomes or performance levels.

We aim to provide reliable, uninterrupted access to the platform, but we do not guarantee 100% uptime. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any feature or service at any time, with or without notice. For material changes, we will make reasonable efforts to provide advance notice.

Enterprise plan users may have specific service-level agreements (SLAs) that supersede the general availability terms described here.

To the maximum extent permitted by applicable law, Tygent and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

This includes, but is not limited to, damages arising from hiring decisions made using the platform's analysis, loss of data, loss of profits, or business interruption.

Our total liability for any claim arising from these terms or your use of the platform shall not exceed the amount you paid for the service in the twelve months preceding the claim, or $100, whichever is greater.

You may close your account at any time through your account settings or by contacting our support team. Upon account closure, your data will be permanently deleted within 30 days.

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the platform in a manner that is harmful to other users or to the platform itself.

Upon termination, your right to access the platform ceases immediately. Provisions that by their nature should survive termination — including data ownership, limitation of liability, and dispute resolution — will remain in effect.

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the platform shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
